Non-Parent Relative Authorization Agreements

Texas law allows a parent to delegate certain rights to a child's grandparent, adult sibling or adult aunt or uncle. Subject to certain limitations, the agreement may be entered into by either parent without the other parent's authorization.

Some of the rights that may be delegated to the non-parent relative include (i) consenting to medical care, including surgical procedures, (ii) obtaining health insurance, (iii) enrolling the child in school, (iv) consenting to extracurricular activities, and (v) authorizing the child to obtain a learner's permit or driver's license. A Non-Parent Relative Authorization Agreement, however, is not valid if there is a pending suit affecting the parent-child relationship (SAPCR) or a previous SAPCR order in effect, unless the agreement is approved by the court.
